Terms of Service — The Cheers Company
These Terms of Service ("Terms") govern your access to and use of the website operated by The Cheers Co ("we", "us", "our").
By placing an order with The Cheers Co, you confirm that you have read, understood and agree to these Terms of Service, along with our Custom Orders & Proofing Policy, Shipping Policy, Returns and Refund Policy, and Privacy Policy.
1. Eligibility & Use of Website
You must be at least 18 years old to place an order on this website.
You agree to use this site lawfully and not for any improper purpose.
2. Orders & Contract Formation
A binding contract is formed when you complete checkout and receive your order confirmation.
All orders are subject to acceptance and availability.
All products are custom made to order.
3. Custom Products & Proofing
All custom design, proofing, approval and production processes are governed by our Custom Orders & Proofing Policy.
You acknowledge that once your final proof is approved, your order cannot be changed or cancelled due to the custom nature of our products.
4. Pricing & Payment
All prices are in Australian Dollars (AUD) and include GST unless stated otherwise.
Payment must be made in full at the time of ordering.
5. Intellectual Property
All content, designs, artwork, images, logos and materials on this website remain the intellectual property of The Cheers Co and may not be reproduced without our written permission.
(Just added the “no reproduction without permission” line to match your other IP clauses.)
6. Customer Content & Marketing Consent
By placing an order, you confirm that any images, photographs or content you supply:
- Are owned by you or you have permission to use them
- Do not infringe third-party rights
You grant The Cheers Co a non-exclusive, royalty-free, perpetual licence to:
- Use, reproduce and display images of your completed products
- Publish those images for marketing, advertising, website, social media and portfolio purposes
If your order includes images of identifiable people (such as faces in mugshot designs), you confirm that you have obtained their consent to provide those images to us and to our use of them for the purposes described above.
If you no longer wish your images to be used for marketing, you may contact us in writing at any time. We will stop using your images in new marketing materials and, where it is reasonable and practical, will remove them from our website and social media. However, we may not be able to remove content that has already been printed, distributed or shared by others.
The collection and use of personal information contained in customer content is also governed by our Privacy Policy.
7. Privacy
Your personal information is collected and handled in accordance with our Privacy Policy, which forms part of these Terms.
8. Limitation of Liability
To the maximum extent permitted by law, The Cheers Co is not liable for indirect, incidental or consequential loss arising from your use of the website or products.
Nothing in these Terms limits or excludes any rights or remedies you may have under the Australian Consumer Law.
9. Force Majeure
We are not liable for failure or delay caused by events beyond our reasonable control, including but not limited to natural disasters, courier disruptions, supplier delays, power outages, industrial action or events impacting production or delivery services.
10. Governing Law
These Terms are governed by the laws of Queensland, Australia.
